Online Learning Management System Company Blackboard may lose its patent if PTO decision goes through - Darlene Darcy, Washington Business Journal
The U.S. Patent and Trademark Office issued a preliminary decision Tuesday that would invalidate Blackboard Inc.'s patent on its e-learning management systems. The patent office began re-examining the 44 claims comprising Blackboard's patent in 2006 at the request of The Software Freedom Law Center, which provides pro-bono legal services to protect open source software. Since then, the D.C.-based company won its patent infringement case against Desire2Learn Inc., based in Canada. Blackboard was awarded $3.1 million and an injunction against Desire2Learn for future sales of its infringing products and services
